TERMS & CONDITIONS
(hereinafter “Terms and Conditions”)
BACKSTAGE CARD DISCOUNT PROGRAM
dated 27.11.2024

1. GENERAL PROVISIONS

1.1. These Terms and Conditions set out the rules of the BACKSTAGE CARD discount program (hereinafter the “Program”).
1.2. The Organizer of the Program is Mokotoska sp. z o.o., with its registered office in Warsaw, ul. Mokotowska 58/2A, 00-534 Warsaw, registered in the Register of Entrepreneurs maintained by the District Court for the Capital City of Warsaw, 12th Commercial Division of the National Court Register under KRS number: 0000455516, NIP: 7010375082, REGON: 146604503, with share capital of PLN 200,000.00, hereinafter referred to as the “Organizer”.
1.3. The Program is addressed to customers (hereinafter: “Participants”) purchasing goods at the Organizer’s Store: MOKOTOWSKA 58 PRO ONLY MAKEUP STORE at ul. Mokotowska 58 in Warsaw (hereinafter the “Store”) or via the Organizer’s website (https://sklep.mokotowska58.com/pl/).
1.4. The aim of the Program is to enable the purchase of selected goods and services on preferential terms and to inform about new products, current offers, and promotions for Professionals. Participation in the Program may also entitle the Participant to participate in promotions related to specific goods or services or other occasions at the Organizer’s discretion. The public or individual nature of such promotions depends solely on the Organizer’s decision.
1.5. The Terms and Conditions apply to both the Organizer and Participants from the moment of publication.
1.6. These Terms and Conditions shall be deemed accepted by the Participant by submitting a declaration in the Application Form available at https://backstagecard.eu/, and for Participants who joined the Program prior to its publication, upon expiry of 7 days from notification of the changes, unless the Participant rejects the Terms by resigning from the Program.

2. JOINING THE PROGRAM

2.1. Any person who meets the participation requirements may join the Program.
2.2. Only a person who:
2.2.1. has full legal capacity, and
2.2.2. completes the Application Form (hereinafter the “Application”), and
2.2.3. demonstrates to the Organizer that they are a professional (hereinafter the “Professional”) as defined by these Terms and Conditions.
2.3. The status of Professional may be granted only to makeup artists and special effects artists actively working for theater, film, TV, fashion shows, circus, opera, cabaret, vaudeville, and photoshoots, as well as to Photography Studios, Beauty Salons, Hair Salons, Makeover Studios, graduates and students of makeup and cosmetic schools, lecturers of makeup and cosmetic schools, set designers, costume designers, dancers, singers, actors, TV presenters, beauty bloggers and vloggers, drag queens, and graduates of makeup courses run by professional makeup schools.
2.4. To confirm Professional status, the Applicant must present at least two documents from the following list:
• a portfolio (including electronic format, such as a website); a portfolio listed on Film Polski (http://www.filmpolski.pl) or IMDb (https://www.imdb.com) does not require additional documents;
• a copy or scan of a CEIDG (Central Registration and Information on Business) or KRS (National Court Register) entry with relevant PKD classification codes;
• link to an agency representing the Professional;
• a certificate from an agency representing the Professional;
• published photoshoots credited with the Professional’s name;
• discount cards from other professional cosmetic brands;
• diploma confirming graduation from a makeup, SFX, acting, or other professional school listed above;
• a reference letter confirming professional employment (issued within 12 months prior to application).
2.5. The Applicant must submit a correctly completed Application along with the required documents listed in 2.4 via https://backstagecard.eu/, owned by MOKOTOSKA SP. Z O.O.
2.6. The Application must be complete, legible, and truthful. The Organizer will only accept Applications that are properly completed and contain all required data, including consent for personal data processing. The Organizer reserves the right to reject an Application in justified cases, such as incomplete or false information, reapplying while already a Participant, or previous exclusion from the Program.
2.7. The Organizer reviews the Application promptly upon receipt.

3. BACKSTAGE CARD NUMBER

3.1. Each person who completes the Application and meets the Program requirements is assigned a unique BACKSTAGE CARD Number by the Organizer (formerly known as “Backstage Card”).
3.2. The Organizer informs the Participant via email of the assigned BACKSTAGE CARD Number or notifies of rejection if the Application does not meet criteria in sections 2.3 and 2.5.
3.3. If the Participant already has an active account at sklep.mokotowska58.com, the Organizer assigns and activates the BACKSTAGE CARD Number in that account.
3.4. If the Participant does not yet have an account, they must enter their assigned BACKSTAGE CARD Number when registering. Activation will be done immediately and confirmed via email.
3.5. Unless decided otherwise, BACKSTAGE CARD holders receive a 20% discount on goods and services from selected Partner Brands listed on https://sklep.mokotowska58.com/.
3.6. The BACKSTAGE CARD Number is valid only:
3.6.1. at MOKOTOWSKA 58 PRO ONLY MAKEUP STORE, ul. Mokotowska 58, Warsaw,
3.6.2. for orders via https://sklep.mokotowska58.com/,
3.6.3. for equipment rentals from BACKSTAGE4RENT (https://backstage4rent.pl/).
3.7. Delivery, transport, assembly, and disassembly services are not covered by the discount.
3.8. A BACKSTAGE CARD Number issued to a natural person is personal and non-transferable.
3.9. A Number issued to a legal entity is not personal, but use requires proof of authorization. Orders must be placed by a representative authorized to act on behalf of the entity.
3.10. Participants must immediately notify the Organizer of changes to their personal data. Failure to do so exempts the Organizer from liability for delays or service failures.
3.11. Discounts obtained under the Program may not be sold, transferred, or exchanged for cash unless stated otherwise in the Terms.
3.12. The Organizer may deactivate or suspend a BACKSTAGE CARD Number if the Program is used against these Terms.

4. LOSS OF PARTICIPANT STATUS

4.1. The Organizer may immediately exclude a Participant if they:
4.1.1. violate the Terms, including providing false data or impersonating another person;
4.1.2. request cessation of personal data processing or object to such processing.
4.2. The Organizer may terminate a Participant’s membership if no purchases are made under the Program for at least 18 months.
4.3. Participation ends in the event of death or termination of the Program (see point 5).
4.4. Upon exclusion, the Organizer has the right to remove the Participant from the Program. Exclusion does not entitle the Participant to any compensation unless explicitly stated in the Terms.
4.5. Participants may resign at any time by submitting a written or email declaration to info@backstagecard.pl. Upon receipt, the Participant is removed from the Program and loses their rights.

5. PROGRAM TERMINATION & AMENDMENTS

5.1. The Organizer reserves the right to suspend or terminate the Program at any time. Such decisions will be published in the Store and on www.mokotowska58.com. Additionally, Participants will be notified via email.
5.2. Termination of the Program voids all related Participant rights.
5.3. The Organizer may amend the Terms at any time.
5.4. The amended Terms will be published in the Store and on https://sklep.mokotowska58.com and https://backstagecard.eu/.
5.5. Use of the BACKSTAGE CARD Number after the amendment implies acceptance of the new Terms.
5.6. Changes do not entitle Participants to compensation.
5.7. Physical BACKSTAGE CARDs issued before the changes remain valid but are no longer required to prove participation.

6. PERSONAL DATA PROTECTION

6.1. By joining the Program, the Participant consents to the processing of their personal data by the Organizer for Program purposes. Consent is given by submitting the Application. Data is protected under the Personal Data Protection Act of 29 August 1997.
6.2. Participants have the right to access and amend their personal data. The Organizer ensures full control rights.
6.3. Data is processed in accordance with the Privacy Policy.
6.4. Participants will regularly receive promotional and commercial communications via email from the Organizer.

7. ACCEPTANCE AND IMPLEMENTATION

7.1. These Terms shall be deemed accepted upon submission of the Application form at https://backstagecard.eu/aplikacja/.
7.2. The Organizer is not liable for any direct or indirect consequences of Program malfunction but will strive to ensure Participants benefit from the discounts.

8. FINAL PROVISIONS

8.1. Any complaints related to the Program, particularly discounts, must be submitted immediately by mail or email to the address indicated in point 1.2 or to info@backstagecard.pl.
8.2. These Terms and Conditions were published on 27.11.2024 and replace the previous version dated 01 February 2024.
